Federal Judge Says Missouri Gun Law Is Unconstitutional

(Farmington) A federal judge ruled Tuesday that a Missouri law invalidating federal gun laws in the state is unconstitutional.

The Missouri Legislature passed the so-called “Second Amendment Preservation Act” in 2021 in which police departments could be sued up to 50-thousand-dollars for violating anyone’s gun rights.

U.S. District Judge Brian Wimes for the Western District of Missouri says federal laws take priority over state laws.

The judge says “While purporting to protect citizens, the Second Amendment Preservation Act exposes citizens to greater harm by interfering with the federal government’s ability to enforce lawfully enacted firearms regulations designed by Congress for the purpose of protecting citizens.”

The case could be appealed.
